Acceptance of Terms

By using our services, signing a service agreement, or engaging a caregiver provided through Maha Cares LLC, you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions.

 

Scope of Services

Maha Cares LLC provides non-medical homecare services, caregiver placement, overnight and live-in care, and babysitting/childcare support.

 

We offer:

• Personal care and companion services

• Babysitting/Childcare support

• Overnight and live-in care

• Non-medical caregiver referrals and placements

 

Maha Cares LLC does not provide medical services, skilled nursing, or therapy unless explicitly stated in a separate, signed agreement.

 

Client Responsibilities

• Clients must provide accurate, complete, and truthful information regarding care needs.

• Clients agree to maintain a safe, respectful, and healthy environment for caregivers.

• Clients must not engage in harassment, discrimination, or inappropriate behavior toward any caregiver.

• Clients are responsible for any special equipment, supplies, or accommodations needed for care.

Caregiver Placement & Employment

• Caregivers referred or assigned remain under contract with Maha Cares LLC unless otherwise agreed in writing.

• Clients may not hire, solicit, or contract directly with any caregiver introduced by Maha Cares LLC for a period of 12 months from the last date of service, unless a placement or buyout fee is paid.

• Unauthorized direct hiring may result in legal action and a fee of up to $3,500 per caregiver.

 

Scheduling, Rates & Payment

• All rates are agreed upon prior to the start of services.

• Payment is due according to the invoice schedule or payment agreement.

• Late payments may incur additional fees.

• Services may be paused or discontinued in the event of nonpayment.

• Overtime, holiday, or last-minute bookings may be billed at premium rates.

Cancellations & Refunds

• At least 24 hours’ notice is required for cancellations.

• Cancellations made with less than 24 hours’ notice may be subject to a cancellation fee.

• Refunds (if applicable) will be processed according to the company’s refund policy.

Terminations of services require at least 2 weeks notice.

Liability & Disclaimer

• Maha Cares LLC carefully screens all caregivers but is not liable for personal injury, loss, or damage arising from caregiver performance or client environment.

• Clients are encouraged to maintain appropriate home insurance coverage.

• Services are provided “as is” and not guaranteed to diagnose, treat, or cure any medical condition.

Confidentiality & Privacy

• Maha Cares LLC respects client privacy and complies with all applicable privacy and data protection laws.

• Personal information will not be shared or sold.

• Both clients and caregivers must respect confidentiality.

 

Safety & Conduct

• Maha Cares LLC reserves the right to refuse or discontinue service if the environment is unsafe, abusive, or not compliant with our care standards.

• Clients must provide emergency contact information and any relevant health or safety instructions.

 

Governing Law

These Terms are governed by the laws of the State of New Jersey.

 

​Changes to Terms

We may update these Terms from time to time. Updates will be posted on our website with a revised “Last Updated” date. Continued use of services after changes indicates acceptance of the updated Terms.
